Cancellation & Cooling-Off Policy

Order cancellation, electronic transactions and statutory cooling-off rights

Effective Date: 26 September 2026
Business: OPCT IT Partners
Website: www.opct.co.za
Email: info@opct.co.za
Address: 639 Rubenstein Drive, Moreleta Park, Pretoria, South Africa

1. PURPOSE

This policy explains how cancellation requests are handled before products are supplied or once work, procurement, licensing or provisioning has begun.

2. CANCELLATION BEFORE WORK STARTS

Where an order has not yet been procured, configured, dispatched, activated or materially worked on, OPCT may allow cancellation subject to any applicable statutory right and the terms of the transaction.

3. CANCELLATION AFTER PROCUREMENT OR WORK STARTS

If OPCT has already ordered equipment, incurred supplier charges, reserved resources, started labour, activated licences or provisioned services, the customer may be responsible for the committed costs and work already performed where legally permitted.

4. ELECTRONIC TRANSACTIONS

Certain electronic transactions may qualify for cooling-off or cancellation rights under applicable South African law, including the Electronic Communications and Transactions Act where its requirements are met. OPCT will honour any right that applies to the specific transaction.

5. EXCLUSIONS AND LIMITATIONS

Not every electronic purchase qualifies for a cooling-off right. The applicable law may exclude or treat certain goods and services differently, including customer-specific, time-sensitive, digital, activated, customised or already performed products and services.

6. SPECIAL-ORDER GOODS

Products sourced or imported specifically for the customer may become non-cancellable once the supplier order is committed, except where the customer has a legal right to cancel.

7. CUSTOM-BUILT AND CONFIGURED SYSTEMS

Cancellation may be restricted once assembly, imaging, configuration, customisation or other customer-specific work begins. OPCT will advise what costs or components have already been committed.

8. SOFTWARE, DOMAINS, HOSTING AND CLOUD SERVICES

Licence keys, subscriptions, domains, cloud resources, hosted services and similar products may become non-cancellable once activated or provisioned where the third-party supplier will not reverse the charge and the law permits this.

9. SERVICE BOOKINGS

For scheduled on-site, project or technical work, reasonable notice should be given if the appointment must be cancelled or moved. Costs already incurred for travel, resources, third-party bookings or completed preparation may remain payable where applicable.

10. HOW TO CANCEL

Send the cancellation request in writing to OPCT and identify the order, quotation, invoice or service concerned. A cancellation is not final until OPCT confirms the cancellation and any remaining financial or return requirements.

11. REFUNDS FOLLOWING CANCELLATION

Where cancellation results in an approved refund, OPCT will deduct only those costs that may lawfully be retained and will process the balance in line with the Refund Policy.

12. RECURRING SERVICES

Recurring support, hosting, connectivity and managed services are governed by the separate Service Cancellation & Termination Policy and by the applicable service agreement.

CONTACT AND LEGAL PRIORITY

Questions about this policy may be sent to info@opct.co.za. Please include the relevant customer, order, invoice, service or ticket reference where available.

These terms are intended to explain OPCT’s standard business practices. They do not remove any right or remedy that cannot lawfully be excluded or limited. If a provision conflicts with mandatory South African law, the applicable law will prevail to the extent of the conflict.

OPCT may update this policy when business processes, services, technology or legal requirements change. The version published on this website is the current public version.
